AI Transparency Policy

AI Transparency Policy of bailaho GmbH

Information on the Use of Artificial Intelligence at bailaho; Version: August 2, 2026

1. Foreword

bailaho GmbH uses modern digital technologies to continuously develop and improve its services, workflows, and digital offerings. This may also include applications and systems based on artificial intelligence (AI). AI may serve various purposes, for example in the creation and editing of texts, the preparation of information, translations, content optimization, or the support of communication processes. With this policy, we aim to provide transparent and comprehensible information about the areas in which AI may be used at bailaho, how corresponding content is created, and under which conditions labeling is required. In doing so, we take particular account of the applicable legal requirements, including the provisions of Regulation (EU) 2024/1689 (EU AI Act) and the applicable data protection regulations.

2. Principles Governing Our Use of AI

The following principles apply in particular to the use of artificial intelligence at bailaho:

  • Transparency: The use of AI should be comprehensible and transparent in accordance with applicable legal requirements.
  • Responsibility: The use of technical systems does not replace bailaho's responsibility for its own business and operational processes.
  • Human oversight: Depending on the specific application, AI-generated results may be reviewed and edited by humans.
  • Data protection: Personal data is processed only where an appropriate legal basis exists.
  • Quality: AI-generated results may contain errors and are therefore reviewed where necessary and appropriate.
  • Legal compliance: AI is used in consideration of the applicable legal requirements.

The specific scope of AI use may change due to technological, organizational, or legal developments.

3. What Is Artificial Intelligence?

By artificial intelligence, we particularly mean software-based systems that are capable of generating content, processing information, or supporting tasks that would ordinarily require human cognitive abilities. This may include systems that:

  • create, edit, or optimize texts,
  • generate or modify images, audio, or video content,
  • analyze information,
  • categorize or structure content,
  • create translations,
  • generate recommendations or suggestions,
  • support research and search processes,
  • automate communication processes, or
  • perform other comparable tasks.

Not every software function that uses automated processes necessarily constitutes an AI system within the meaning of applicable law.

4. Where May bailaho Use AI?

AI may be used at bailaho in various areas as a technical tool. These may include, in particular:

Editorial and Content

  • Creation and revision of company texts,
  • optimization of company descriptions,
  • structuring and summarizing information,
  • linguistic improvement of content,
  • search engine optimization (SEO),
  • translations and linguistic adaptations.

Company Profiles

AI may be used to prepare, structure, and optimize information for company listings. For example, existing company information may be reformulated into a more comprehensible or search-engine-friendly format.

Graphics and Media

AI may be used to support the creation or editing of:

  • graphics,
  • images,
  • advertising materials,
  • audio content, or
  • video content.

Communication and Customer Service

AI-supported systems may be used, for example, to support:

  • chatbots,
  • customer inquiries,
  • automated responses,
  • the provision of information, or
  • internal communication processes.

Marketing and Advertising

AI may also be used in the creation and optimization of:

  • advertising copy,
  • advertisements,
  • banners,
  • social media content,
  • landing pages,
  • SEO content, and
  • other marketing materials.

Internal Processes

AI may also be used in internal workflows, research, data preparation, quality control, structuring, and technical processes.

5. AI as a Tool – Not Every Use of AI Means “AI-Generated”

An important principle of this policy is the distinction between content generated entirely by AI and content created or editorially controlled by humans in which AI was merely used as an assisting tool. AI may, for example, be used only for:

  • spell checking,
  • grammar checking,
  • translation,
  • formatting,
  • summarization,
  • structuring,
  • idea generation, or
  • linguistic optimization.

In such cases, there is not automatically an obligation to label the entire content as “AI-generated”. Whether labeling is required depends on the specific use of the AI system and the applicable legal requirements.

6. Human Review and Editorial Responsibility

Where required or appropriate for the specific application, AI-generated or AI-assisted content may be reviewed and edited by employees or commissioned individuals. Such editing may include, for example:

  • checking for obvious factual errors,
  • linguistic corrections,
  • adjustment of wording,
  • comparison with available information,
  • shortening or expanding content,
  • editorial revision, or
  • adaptation to the requirements of the respective publication format.

Human editing does not automatically mean that a legally required disclosure or labeling obligation no longer applies. The applicable legal requirements are decisive.

7. Transparency and Labeling

Not every use of artificial intelligence results in visible labeling. Labeling may be required in particular where this is legally required due to the nature of the content, the AI system used, or the specific publication. The following notices may be used, for example:

“AI-generated”

“Created with the assistance of artificial intelligence”

“AI-generated and editorially reviewed”

Depending on the content and technical implementation, other appropriate notices or technical markings may also be used. The specific form of labeling depends on the applicable legal requirements and the available technical options.

8. AI-Generated Images, Videos, and Audio Files

Special transparency requirements may apply to images, videos, or audio files that are fully or partially generated by AI or substantially modified using AI. Where labeling is required, this may be implemented, for example, through:

  • a visible notice,
  • metadata,
  • machine-readable information,
  • provenance information,
  • Content Credentials, or
  • other appropriate technical procedures.

Technical labeling does not necessarily have to be immediately visible to the user.

9. AI-Generated and AI-Assisted Texts

With regard to textual content, it is particularly important to distinguish between different forms of AI use.

A text generated entirely automatically must be assessed differently from a text written by a human that has merely been checked for spelling, grammar, or linguistic clarity, for example. There are also different degrees of human involvement between these forms of content creation.

bailaho therefore takes into account the specific content creation process and the applicable legal requirements. Where labeling is legally required, it will be provided in an appropriate form.

10. AI-Supported Communication

If bailaho uses an AI-supported chatbot or comparable system to communicate with users, bailaho will, where legally required, provide transparent information that the user is interacting with an AI system. Such a notice may, for example, read:

Notice: You are currently communicating with an AI-supported assistant system.

If communication is subsequently taken over by an employee, this transition may also be appropriately indicated.

11. Company Data and Customer Content

When creating, editing, and maintaining company listings, information provided by companies or customers may be processed. This may include, for example:

  • company data,
  • company descriptions,
  • texts,
  • images,
  • logos,
  • trademarks,
  • product information,
  • descriptions of services, and
  • other content.

The respective customer remains generally responsible for ensuring that the content they provide may lawfully be used, is accurate, and does not infringe the rights of third parties. The use of AI as a technical tool does not alter this responsibility.

12. Data Protection and Personal Data

The protection of personal data is of great importance to bailaho. Personal data is processed in connection with AI systems only where an appropriate legal basis exists. In particular, bailaho takes into account:

  • the General Data Protection Regulation (GDPR),
  • the German Federal Data Protection Act (BDSG),
  • the German Telecommunications and Digital Services Data Protection Act (TDDDG), and
  • other applicable data protection regulations.

Personal data is not transmitted to AI systems without an appropriate purpose and the required legal basis. Further information on the processing of personal data can be found in the current Privacy Policy of bailaho.

13. Use of External AI Services

For certain tasks, bailaho may use technical services provided by external providers. These may include applications for:

  • text processing and text generation,
  • image generation,
  • translation,
  • research,
  • analysis,
  • automation, or
  • customer communication.

Where personal data is processed as part of such services, the relevant processing activities will be taken into account in accordance with the applicable data protection requirements.

14. AI in Advertising and Marketing

AI may also be used in the creation, editing, or optimization of advertising and marketing content. This may include, for example:

  • advertisements,
  • banners,
  • texts,
  • graphics,
  • social media posts,
  • SEO content,
  • landing pages, and
  • other marketing measures.

The use of AI does not affect the general legal requirements applicable to advertising. In particular, advertising content must continue to comply with the applicable requirements concerning transparency, the recognizability of commercial communications, and the prohibition of misleading advertising. Where specific labeling is required by law, this will be taken into account.

15. Limitations of Artificial Intelligence

AI systems do not operate without errors. Even modern systems may, for example:

  • misinterpret information,
  • use incomplete or outdated information,
  • present relationships or connections incorrectly,
  • state facts inaccurately,
  • misattribute sources, or
  • generate content that requires additional review.

AI-generated results therefore do not necessarily constitute binding or conclusive factual determinations. Where required by the specific application, AI-supported content is reviewed and, where necessary, corrected. Unless expressly agreed otherwise, no guarantee is provided that AI-generated results are completely error-free.

16. Customer Orders and the Use of AI

If a customer commissions bailaho to create or edit texts, images, advertising materials, or other content, the use of AI-supported tools may form part of the internal workflow. If a customer expressly wishes for fully manual processing without the use of AI-supported tools, this must be expressly agreed before the relevant service begins. Such an individual agreement may affect the scope of services, processing time, and remuneration.

17. Labeling of Company Listings

Company listings may be edited editorially, technically, or with the assistance of AI-supported tools during their creation or maintenance. The mere use of an AI system as an assisting tool does not automatically mean that an entire company listing must be labeled as “AI-generated”. The decisive factors are the specific nature and extent of the AI use and the applicable legal requirements. Where a legal labeling obligation applies to specific content, bailaho will comply with this obligation in an appropriate manner.

18. Technical Provenance and Labeling Information

Where technically possible and legally required, AI-generated or substantially AI-modified content may be provided with technical information regarding its origin or creation process. This may include, among other things:

  • metadata,
  • machine-readable labels,
  • Content Credentials,
  • provenance information, or
  • comparable technical standards.

Such information may not be immediately visible to users.

19. Further Development and Amendments to This Policy

The technological and legal framework governing artificial intelligence is subject to ongoing development. Changes may result, among other things, from new:

  • European or national legislation,
  • regulatory requirements,
  • guidelines,
  • technical standards,
  • codes of conduct, or
  • court decisions.

bailaho will adapt its own processes and this policy as necessary to reflect changes in the legal or technological framework. The current version published on the website shall apply in each case.

20. Relationship to Other Legal Information

This AI Transparency Policy supplements the other legal information provided by bailaho. In particular, the current versions of the following documents should also be taken into account:

  • Privacy Policy,
  • General Terms and Conditions,
  • Cancellation Policy,
  • Refund Policy,
  • Legal Notice.

For the processing of personal data, the provisions and information contained in the current Privacy Policy are particularly authoritative.

21. Final Provision / Severability Clause

If any provision of this AI Transparency Policy is or becomes wholly or partially invalid, unenforceable, or incapable of being implemented, the validity of the remaining provisions shall remain unaffected. To the extent legally permissible, the invalid, unenforceable, or incapable provision shall be replaced by a provision that comes as close as possible to the economic and substantive purpose of the original provision. The same shall apply if this policy contains any regulatory gap.
